Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Sovereign Systems (“Cadence,” “we,” “us,” or “our”). By creating an account, joining the waitlist, or using Cadence, you agree to these Terms and to our Privacy Policy.

If you do not agree to these Terms, please do not use Cadence.

Cadence is intended for adults. You must be at least 18 years old, or the age of majority where you live, to create an account.

Accounts are held by a parent or guardian who sets up and manages profiles for the students in their household. You are responsible for the activity in your account, including the student profiles you create.

You agree to provide accurate information when you register and to keep it current. You are responsible for keeping your login credentials confidential and for all activity that happens under your account.

Notify us promptly at admin@recordcadence.com if you believe your account has been accessed without your permission.

Cadence is a planning and recordkeeping tool that helps families organize lessons, capture everyday learning, track progress, and maintain records. Features may change over time as we improve the product.

Cadence is a planning and recordkeeping tool. It does not provide legal, educational, tax, or compliance advice.

Homeschool requirements vary by location and change over time. You remain responsible for understanding and meeting the homeschool requirements that apply to you, and for confirming details with official sources. Any information or templates provided in Cadence are for general organizational purposes only.

Cadence lets you create and upload content, including plans, notes, records, and files (“User Content”). You are responsible for the User Content you add and for having the rights needed to add it.

You keep all ownership of your User Content. We do not claim ownership of the plans, notes, records, or files you create or upload.

To provide Cadence, you grant us a limited, non-exclusive license to host, store, process, display, and back up your User Content solely to operate and provide the service to you and to the people you choose to share it with. This license exists only so we can run the product. It ends when you delete the content or close your account, except for backup copies kept for a limited time or copies we are required to keep by law.

You agree not to use Cadence to:

• Upload or share content that is unlawful, harmful, harassing, or that infringes or violates someone else’s rights.
• Upload content you do not have the right to share.
• Access accounts, data, or systems that are not yours.
• Interfere with, disrupt, probe, or reverse-engineer the service.
• Use the service to violate any applicable law or regulation.

We may remove content or limit access that violates these rules.

Student profiles and information are created and controlled by the account holder. You confirm that you are the parent or guardian of, or are otherwise authorized to keep records for, the students you add. How this information is handled is described in our Privacy Policy.

Cadence may link to or rely on third-party services, such as Vercel and Stripe. We are not responsible for third-party services, and your use of them may be subject to their own terms and policies.

We may offer a waitlist, beta, or early-access features. These are provided as is, may change or be withdrawn at any time, and may be less reliable than generally available features. Joining the waitlist does not guarantee access to the product.

Cadence may offer paid plans. If it does, the price, billing interval, and what is included will be presented to you before you subscribe.

You authorize us and our payment processor, Stripe, to charge the payment method you provide for the fees that apply to your plan.

You can cancel a paid plan at any time through your account.

Unless required by law or stated otherwise at the time of purchase, cancellation stops future charges but does not automatically refund amounts already paid.

We may add, change, or remove features, and we may set limits on the service. We work to keep Cadence available and reliable, but we do not promise that it will be uninterrupted, error-free, or available at all times. Access may be affected by maintenance, updates, or events outside our control.

You may stop using Cadence and close your account at any time. We may suspend or terminate an account that violates these Terms, creates risk or legal exposure, or misuses the service. Where practical, we will provide notice.

You can export your content while your account is active. After your account is closed, we delete or de-identify your content as described in the Privacy Policy, except where we are required to keep it to meet legal obligations. Consistent with the Privacy Policy, you may request access, correction, export, or deletion by contacting admin@recordcadence.com.

Cadence, including its software, design, and branding, is owned by Sovereign Systems and its licensors and is protected by intellectual property laws. These Terms do not give you any right to our name, logos, or brand except as needed to use the service. This does not affect your ownership of your User Content.

If you send us ideas, suggestions, or feedback, you agree that we may use them to improve Cadence without any obligation or payment to you.

Cadence is provided “as is” and “as available,” without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the service will meet your requirements, be uninterrupted, or be error-free.

As noted above, Cadence does not provide legal, educational, tax, or compliance advice.

To the fullest extent permitted by law, Cadence and Sovereign Systems will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data or content, arising from or related to your use of the service.

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Sovereign Systems from claims, losses, liabilities, and expenses that arise out of your User Content, your use of the service, or your violation of these Terms.

If a dispute arises, we ask that you first contact us at admin@recordcadence.com so we can try to resolve it informally. If we are not able to resolve it that way, the dispute will be handled by the state or federal courts located in Texas, and you and Sovereign Systems each consent to the personal jurisdiction of those courts.

Cadence is operated by Sovereign Systems in the United States. These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law principles.

We may update these Terms as the product and our practices change. When we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice. Continued use of Cadence after changes take effect means you accept the updated Terms.
